Terms of Service for the Texas Electricity Plans ChatGPT Connector

Meter Energy Inc. (“Meter Energy,” “we,” “our,” or “us”) provides the Texas Electricity Plans connector (the “Connector”) as an informational tool to help users compare electricity plans available in Texas and, on request, pull their own smart meter usage from Smart Meter Texas. By using this Connector inside ChatGPT, you agree to these Terms of Service.

1. Acceptance of Terms

By using the Connector, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Connector.

2. Description of Service

The Connector is an informational comparison tool that:

• Displays Texas electricity plan data sourced from public regulatory data and our retail catalog
• Lets you filter and compare plans by ZIP code, monthly usage (kWh), contract length, renewable percentage, and retailer
• On request, pulls up to 12 months of 15-minute usage for a Texas smart meter from Smart Meter Texas and returns a usage summary and download files (see Section 3)
• Provides links to Meter or retailer websites where you can complete enrollment

Important: The Connector is for informational purposes only. Meter Energy does not process electricity enrollments through the Connector, and pulling your meter data never enrolls you in a plan or changes your electricity service. Sign-up links open Meter or third-party retailer websites, where you complete enrollment separately under the applicable terms.

3. Smart Meter Texas Data

When you ask the Connector to pull usage for a meter, you give us the meter's ESI ID (or service address), meter number, and current electricity provider, and we create a Smart Meter Texas data-sharing agreement for that meter on your behalf. By making that request you confirm that:

• You are the account holder for that meter, or you have the account holder's permission to access its usage data
• The identifiers you provide are accurate and belong to that account
• You authorize Meter Energy to create the data-sharing agreement and to accept its confirmation for you

You also understand that:

• The readings come from Smart Meter Texas as reported by your utility. We do not alter them, and we are not responsible for gaps or errors in the source data
• We store the pulled readings and identifiers so the result and download links work after the conversation, and a repeat request for the same meter within 24 hours reuses the stored pull. You can ask us to delete the data at any time (see Section 10)
• Download links work without a login. Anyone who has a link can download the file, so do not share links you want kept private
• We use your meter data only to produce the usage summary, the download files, and plan comparisons. We do not sell it
• You can end the data-sharing agreement at any time from your Smart Meter Texas account

Requesting data for a meter you are not authorized to access is a breach of these terms. Our Connector Privacy Policy describes what we collect and store in full.

4. No Guarantee of Accuracy

While we strive to provide accurate information:

• Plan prices, terms, and availability change frequently and may not reflect the most current offerings
• Estimated monthly costs are based on the usage amount you provide, or on the usage pulled from Smart Meter Texas, and may differ from your actual bills
• You should always verify plan details, pricing, and terms directly on the retailer's Electricity Facts Label (EFL) and the retailer's website before enrolling

5. Third-Party Links and Services

The Connector contains links to third-party retailer websites. When you click a third-party sign-up link:

• You will be directed to the retailer's website, which is governed by their own terms and privacy policies
• Any agreement you enter into is with the retailer. Meter Energy is not a party to that agreement
• Meter Energy is not responsible for the content, accuracy, or practices of third-party websites

6. Limitation of Liability

To the fullest extent permitted by law, Meter Energy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Connector, including but not limited to decisions made based on plan information displayed, enrollment with any retailer, the accuracy or availability of Smart Meter Texas data, or any issues with electricity service.

The Connector is provided “as is” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Appropriate Use

You agree to use the Connector only for lawful purposes and in accordance with these terms. You agree not to:

• Use the Connector for any commercial purpose without our prior written consent
• Attempt to interfere with or disrupt the Connector's operation
• Use automated systems to access the Connector in a manner that exceeds reasonable use
• Request Smart Meter Texas data for a meter you are not authorized to access

8. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the Connector after changes are posted constitutes acceptance of the revised terms.

9. Governing Law

These Terms of Service are governed by the laws of the State of Texas, without regard to conflict of law principles.
